Mexican national arrested in El Paso for alleged illegal re-entry

A Mexican national, previously convicted of sexually assaulting a minor, has been arrested in El Paso on charges related to illegal re-entry into the United States. Court documents reveal that Jose Juan Garcia Tiro was found to be in the country illegally following his arrest. He had been deported to Mexico on April 23, 2015.

In 2007, Garcia Tiro was convicted in Ocean, New Jersey for sexually assaulting a prepubescent minor and was sentenced to eight years in prison. He now faces one count of illegal re-entry and could face up to ten years in prison if convicted. His detention without bond was ordered during a hearing on February 10. The final sentence will be determined by a federal district court judge who will consider U.S. Sentencing Guidelines and other statutory factors.

The announcement was made by U.S. Attorney Jaime Esparza for the Western District of Texas. The U.S. Border Patrol is leading the investigation, while Assistant U.S. Attorney Patricia Aguayo is handling the prosecution.

It is important to note that a criminal complaint is merely an allegation and all defendants are presumed innocent until proven guilty beyond a reasonable doubt in a court of law.
